This privacy notice (this “Notice”) describes how we collect, use, store, share and protect personal information collected from or about visitors to our websites (including https://wynnbet.com) and mobile applications (including the WynnBET mobile application) published under the WynnBET brand (collectively, the “Services”), made available by WSI US, LLC (“we,” “us,” or “our”).

The practices described in this Notice apply only to our use of information supplied to us. Information collected from you by others, including third-party providers that you access through links on the Services, including any payment and withdrawal systems, are governed by those entities’ privacy policies. 1. Practices Covered by this Notice

This Notice describes our privacy and data practices in relation to the personal information we collect from individuals who use the Services. Please read this Notice carefully to understand how we collect, use, and process personal information in connection with the Services. By visiting, accessing, or using the Services, or providing information to us in connection with the Services, you acknowledge our collection, storage, use, and sharing of your information as described in this Notice. Please note that if you disagree with anything in this Notice, you should not visit, access, or use the Services; nor should you provide information to us in connection with the Services. When you create an Account (defined below), you will be enrolled in the Wynn Rewards program, or if you are already enrolled, your Account will be associated with your existing Wynn Rewards account. This Notice does not cover any website or system other than those under the WynnBET brand. Any other sites operated by Wynn Resorts Holdings, LLC and its affiliates are subject to separate terms and privacy notices found on those sites. Please refer to the terms and conditions and privacy notices associated with such other sites and services for more information on the practices associated with the use of those sites.

2. What Information is Collected from or About You, and How

We collect information from or about you at many, diverse points of interaction within the Services. We maintain integrated profiles of our customers, in keeping with the highest industry standards for an exceptional customer service experience. Thus, gaming or other activities tracked on your Account may be paired with other information we collect from or about you, as such information is described further below, in order to personalize your experience and deliver the benefits and opportunities through the Services and our affiliates.

How We Collect Information

  • Online Enrollment Process – We offer the option to register for a WynnBET account (“Account”), by submitting an online form, collecting your first and last name, date of birth, mobile phone number, residential address, last four digits of your social security number, and e-mail address. We will ask you to create a password to manage your Account.

  • Marketing – We collect name and contact information directly for marketing purposes, for example when you sign up for promotional messages online or through the Service.

  • Voluntary Information – We collect information which you provide to us voluntarily when you communicate with us directly through our Services. This includes information you share with us through your use of the Services, help links, or customer service. Where you choose to self-exclude or self-limit, we will collect your personal information in relation to this request.

  • Financial Transactions and Privileges – We collect or use your name, e-mail address, residential address, phone number, Account details, full social security number and tax filing information in connection with financial dealings with the Services or to administer and service an Account. We also collect, where applicable, banking information that is necessary to process payments or other transactions, such as withdrawals and deposits related to your Account.

  • Social Media – When you interact with us through social media (including Facebook, Instagram, Twitter, WhatsApp, and Snapchat) we collect personal information, such as your social media profile information and online behavior through this interaction, consistent with your settings within the social media service. If you have provided us with your telephone number or email address, we may use this information to send targeted advertisements to you on these social media properties.

  • Customer Support – We collect personal information from you such as your name and contact information when you:
    - Contact us for any reason and/or request or receive services or information;
    - Report any problems, and/or are in dispute with us;
    - Contact us through our customer service; and
    - Contact us through social media channels.

Please note that telephone calls to our concierge, customer service, and call center are recorded and actively monitored for the purposes of compliance, security and customer service.

Information We Collect Automatically

When you use the Services, we automatically collect the following information:

  • Technical information, including your login information, domain server, web browser or mobile application type and version, the pages you visit on our websites or within the mobile application, time zone setting, browser plug-in types and versions, mobile device identification, operating system, and platform;

  • Geo-location information, including without limitation your location coordinate data;

  • All details of wagers, deposits, and withdrawals;

  • IP address, this is identified and logged automatically in our server log files when you access the Services. We use IP addresses to calculate usage levels, diagnose server problems, and administer our Services. We also may derive your approximate location from your IP address; and

  • Website visit information, including the full Uniform Resource Locators (“URL”) clickstream to, through, and from our websites (including date and time); items you viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs); and methods used to browse away from the page.

Information Received from Third Parties

We also collect information about you (as relevant and appropriate to the Service you have requested) from third parties, including:

  • Consumer reporting agencies, in connection with identity and age verification and in relation to your financial account;

  • Bank or payment providers with whom you choose to do business for purposes of interacting with the Services, for example, when you choose to link your bank account in order to receive or pay funds to the Services;

  • Social media channels, such as Facebook or Instagram, consistent with your settings on such services;

  • Your location information;

  • Marketing and analytics providers; and

  • Third party analytics services and content from third party businesses, including as described in our Cookie Notice.

  • Third party service providers to enrich data.

This information includes contact information such as your name, e-mail address and phone number. It also includes, where applicable, payment information, online browsing and usage behavior and social media profile information. We will also obtain e-mail addresses and limited demographic information for our US customer accounts where we do not hold a current e-mail address or demographic information for such customer and append this to the customer account.

3. How We Use Your Information

We use your information for various purposes, including:

  • To send you personalized messages, publications, news, and information about events, special offers, promotions, and benefits, as well as measure and understand the effectiveness of the content we serve to you and others.

  • As described in our Cookie Notice.

  • To improve the Services and enhance users' experiences when using the Services and to customize the content and layout of the Services to each individual user.

  • To administer the Services, keep the Services safe and secure, monitor and analyze the Services’ usage and activity trends, to operate and improve the Services, and for internal operations, to conduct troubleshooting and data analysis, including testing, research, statistical and survey analysis.

  • To enforce our terms and conditions.

  • To facilitate the processing of online payment, sending administrative messages and provide you with related customer service.

  • To respond to your queries, and to communicate with you about your requests or transactions.

  • For analytics purposes, to optimize your experience, enhance our marketing, create customer or audience segments, enhance our business and operational efficiency and tailor promotions and offers to your preferences and habits when interacting with us.

  • To offer, manage and administer your Account, assess your benefits, administer offers and manage your choices regarding how you wish to use your offers.

  • To maintain the accuracy of your Account or profile information and to provide you with a better and more personalized service, including by pairing information collected under this Privacy Notice with your Wynn Rewards profile.   • To facilitate our operations, including account management and requests.

  • To contact you if you have been awarded a prize through a promotion, such as merchandise, resort stays, or event ticket, that requires communication to fulfill.

  • To carry out appropriate compliance, security and/or financial checks, such as when we need to confirm your age or identity, make a payment to you, receive payment from you, or comply with law enforcement, court, and regulatory obligations.

  • When you use the Services, we collect your location coordinate data. A record confirming your presence within the state where you are located may be retained for up to 10 years as may be required by applicable state and federal regulations. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property or as detailed in this Notice. Our third- party geolocation service, operated by GeoComply Solutions, Inc., will make use of your location data. If you use the Services, you consent to us transmitting, collecting, maintaining, processing, and using your location data in order to provide and improve location-based services. Consent to such use and processing of your location data is required for continued use of the services and may not be withdrawn.

  • We may also enrich, match or combine information we hold about you with data from other sources, for instance by receiving some of your personal data with selected business partners. We do this to better understand your customer profile and interests so that we can deliver customized offers and other personalized services.

4. Managing Your Information and Marketing Preferences

You may decline to share certain information with us, in which case we may not be able to provide to you some of the features and functionality found on the Service. To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. If you create an Account, you are responsible for maintaining the secrecy of your unique password and account information at all times.

Opting out of marketing or restricting marketing sent to you will not prevent your Personal Information from being shared with our affiliates for any purpose or used for other non-marketing purposes described in this Notice.

Our privacy practices are subject to applicable laws in the places in which we operate. Depending on your state of residency, you may have specific rights related to your personal information that we handle. Those rights may include, without limitation, the right to request information about how WynnBET processes your personal information, access a copy of your personal information held by WynnBET, update your personal information, or request that your personal information be erased from WynnBET’s systems when WynnBET is no longer required to retain it.   • E-mail Opt-Out - You may withdraw your consent for direct marketing communications at any time by logging in to your Account and updating your communication preferences.   • Telecommunications Opt-Out – You may choose whether to provide your phone number to receive text messages or advertising phone calls from us or our call center agents using an automatic telephone dialing system or an artificial or prerecorded voice. By providing your phone number and express consent, you are choosing to receive such messages until you withdraw your consent. Your consent to receive text messages or pre-recorded calls using an automatic telephone dialing system is not required to use the Services. You may revoke your consent at any time by replying “Stop” to a text message or by contacting Customer Support.

  • Push Notifications – When you install our apps on your mobile device you can choose to receive push notifications, which sends messages to your mobile device even when the app is not open. You can turn off notifications by visiting your mobile device’s “settings” page or through the notifications page in the app.

  • Direct Mail Marketing Opt-Out – When you create an Account, you must provide a mailing address as part of the identity verification process. You are responsible for keeping your address up to date on the Account, but your consent to receive marketing materials at that address is not required to use the Account or any portion of the Services and you may opt out of receiving such communication at any time by competing the direct mail marketing opt-out form, at https://www.wynnbet.com/directmail/.

5. How We Share Your Information

We share your personal information only with selected recipients which include the following:

  • Wynn Rewards – Wynn Rewards is the Wynn loyalty program, offering rewards at WynnBET and Wynn resorts. When you create your WynnBET account, your personal information, (such as name, contact details, date of birth, and gaming history), will be shared with other Wynn companies to identify whether you have an existing Wynn Rewards account. If you already have a Wynn Rewards account, your WynnBET Account will be linked to it. If not, your personal information will be used to create a Wynn Rewards account.   • Wynn Group - For business purposes, we may share certain personal and non-personal information, (such as name, contact details, date of birth, and gaming history), we receive from you, and about your transactions with us, with any of our corporate affiliates (the Wynn companies), including our owned, operated, and managed casinos, online, mobile and web based businesses, and other corporate entities or affiliates, including without limitation, Wynn Las Vegas, Encore Boston Harbor, and Wynn Resorts. Doing so allows us to provide the products and services you have requested and quickly respond to your inquiries. In addition, we share your personal information to our affiliates for marketing purposes, facilitating Wynn Rewards, to personalize an exceptional customer experience across Wynn sites and services, and to fulfill your requests, such as responding to applications for a line of credit, advance, or other financial services or administering our self-exclusion or Wynn Rewards programs.

  • Service Providers - We disclose your personal information to vendors, consultants, and other service providers such as geo-location services, credit or background check companies, payment processors, marketing companies, e-mail service providers, advertising networks and advertisers, information technology services and those who need access to such information to provide services on our behalf. We also disclose your personal information to our land-based casino partners to facilitate the Services, manage your Account, process payments, and provide other essential services.

  • Analytics and Search Engine Providers - We share personal information with these providers to assist us in the improvement and optimization of our guest records and the Services. For more information, please see our Cookie Notice. We may also share your information with affiliated or non-affiliated third parties on an anonymous or aggregate basis.

  • Compliance and regulatory purposes - We share your personal information with law enforcement agencies, public authorities or other third parties if legally required to do so, or if we have a good faith belief that such use is reasonably necessary to:

  • Compliance with Self-Exclusion Requirements – If you choose to self-exclude from our services, we will share your personal information with certain other entities, as required by various laws, regulations, and agreements. Depending on your location and the state(s) where you use the Services, this may include the sharing of your personal information with Wynn affiliates, our land-based casino partners, state agencies, and other online gaming operators.

  • Sale or Merger - We will also disclose your information to third parties in connection with actual or anticipated business transfers or bankruptcy proceedings, as permitted by law:

    • In the event we sell any business or assets, in which case we will disclose your data to the buyer of such business or assets; or

  • Gaming Authorities - All personal and non-personal information processed by us may be made available to the state gaming regulators and relevant authorities governing our business.

6. Cookies and Tracking Technologies

We use cookies, tags, and other similar technologies to collect information about your browsing activities over time and across different websites or online services following your use of our Services, including websites and our mobile applications. These technologies allow us to recognize your preference information, keep track of your purchases, recognize and remember your WynnBET account, and facilitate effective site administration. For your own online security, please do not send payment card numbers or any other confidential personal information to us via e-mail.

8. Third Party Websites and Links

The Services may contain hyperlinks to other websites or systems that may have information policies and practices that are different from ours, such as payment product websites you may use for making and receiving payments within the Services. The fact that we have provided a link to a site is NOT an endorsement, authorization, sponsorship, or affiliation by us with respect to such site, its owners, or its providers. 9. Minimum Age Requirements

Persons under the age of twenty-one (21) are not permitted to gamble online or through the Services. Any offers we make or any contests we conduct, unless otherwise noted, are not open to persons younger than 21. Persons younger than 21 years of age are not allowed to use our Services, accept offers, or win contests. We reserve the right to verify age at any time for any reason and may decline to provide products, services or access rights to any person who does not have valid age identification.

We do not knowingly or intentionally collect any personally identifiable information from, or market to, individuals under the age of 21. Our online services are not intended for persons under the age of 13. The Services are not intended for persons located outside of the states where we are licensed to operate, including without limitation to residents of the European Economic Area, United Kingdom, People’s Republic of China, or Macau SAR. We do not intentionally collect, store, use, or share personal information from users residing outside the U.S. If you are not a resident of the U.S., use of the Services are a violation of the Terms of Service, and you should immediately cease any use of the Services.
